A new proposal by the Morena caucus seeks to ensure that children who abandon their parents could lose the right to receive their inheritance in Mexico City. The initiative was presented to the Mexico City Congress and proposes creating a registry to identify these cases.
Pedro Haces Lago, a deputy for Morena, was the one who presented the initiative which, as he explains, seeks to create a Registry of Abandonment of Elderly Persons, with the goal that children who abandon their parents lose the right to receive an inheritance.
Morena proposes stripping inheritance from children who abandon their parents
Under the slogan "if you weren't there in life, don't show up just for the inheritance," Haces Lago explained that this is a proposal to defend the dignity of older adults and recognize that "caring for those who cared for us cannot be optional."
In an interview with Macanazo Informativo, the Morena deputy assured that this initiative was born from "citizen demand," as during his tours of the Tlalpan borough he has observed cases of abandonment of older adults by their children.
"Given the abandonment of your father, your mother, your grandmother, your grandfather, you should not have the right to the inheritance, it comes from a citizen demand... there are many older adults in Tlalpan... we are a borough where there are many older adults and, well, touring the streets, also participating with older adult collectives, we see the abandonment, and mainly the complaint that when they are making their will while alive or the older adult dies, well, their children mostly abandon them," he explained.
How would the Registry of Abandonment of Elderly Persons work?
The Morena deputy explained that a family court judge would be the one to determine if a son or daughter should be enrolled in this registry, after the older adult files a lawsuit.
"Whoever would register the child would be a family judge. When the lawsuit arrives, the judge analyzes and sentences, well, they rule and decide the path."
According to Haces Lago, the initiative seeks to have this registry function both before and after the death of the older adult.
The deputy pointed out that, if there are conflicts before the death of the older adult, the person could go to file an action when they consider that one of their children has abandoned them.
"If there are conflicts prior to the death, mainly where people say 'my daughter or my son abandoned me,' well, they can go to file these types of actions and the logic is the before the death, but also the after the death, once a registry exists."
