Marrying a U.S. citizen or a lawful permanent resident can open the door to U.S. permanent residency, known as a Green Card. However, marriage alone does not automatically grant immigration benefits. The applicant must follow a formal process with U.S. Citizenship and Immigration Services (USCIS) and, in some cases, with the U.S. Department of State.
Below, we explain step-by-step how the process works, which forms are required, and what the main requirements are.
Who can apply for residency through marriage?
Permanent residency through marriage is available to spouses of:
- Ciudadanos estadounidenses.
- Residentes permanentes legales (titulares de Green Card).
In both cases, immigration authorities require proof that the marriage is legitimate and was not entered into solely for immigration purposes.
Step 1. Submit the I-130 family petition
The first step consists of filing Form I-130, Petition for Alien Relative, through which the citizen or permanent resident requests that the government officially recognize the marital relationship.
According to USCIS, along with the petition, you must generally submit documents that prove the relationship, including:
- Acta de matrimonio.
- Evidencia de terminación de matrimonios anteriores, si los hubo.
- Documentos que acrediten la ciudadanía o residencia permanente del peticionario.
- Fotografías y otros documentos requeridos por USCIS.
It is important to note that approval of the I-130 does not automatically grant immigration status or a Green Card; it simply establishes that there is an eligible family relationship.
Step 2. Determine the processing path
The process can follow two distinct routes depending on where the foreign spouse is located.
Adjustment of status within the United States
If the spouse is legally in the United States and meets the requirements, they could file Form I-485, Application to Register Permanent Residence or Adjust Status.
Spouses of U.S. citizens can generally file Forms I-130 and I-485 simultaneously when they are eligible.
Consular processing from abroad
When the spouse lives outside the United States, after the I-130 is approved, the case is sent for consular processing. Subsequently, the corresponding U.S. embassy or consulate provides instructions to continue with the immigrant visa application.
Step 3. Submit financial documents
As part of the process, the sponsor must demonstrate that they have the financial ability to support the applicant through an Affidavit of Support. The goal is to prove that the immigrant will not rely on public assistance.
Authorities may request tax returns, proof of employment, and other financial documents to evaluate the case.
Step 4. Medical exam and biometrics
Applicants for permanent residency must generally complete a medical exam conducted by doctors authorized by U.S. immigration authorities. They must also provide biometric data, such as fingerprints, a photograph, and a signature.
These checks help verify the applicant's identity and conduct background checks.
Step 5. Attend the interview
In many cases, the couple must attend an immigration interview. During this stage, an officer reviews the documentation and may ask questions about the relationship to confirm that the marriage is authentic.
Some common questions may refer to:
- Cómo se conocieron.
- Dónde viven.
- Actividades cotidianas compartidas.
- Información familiar básica.
Consistency in answers and the evidence presented are important factors during this stage.
Step 6. Receive the decision
If the application is approved, the spouse obtains lawful permanent residency. However, the duration of the Green Card will depend on how long the couple has been married.
Conditional residency
If the marriage is less than two years old at the time the residency is approved, conditional residency valid for two years is typically granted.
10-year permanent residency
If the marriage is two years or older at the time of approval, a Green Card with a standard 10-year validity is generally issued.
What happens after receiving conditional residency?
Conditional residents must apply to remove conditions before their card expires in order to retain permanent residency. USCIS requires proof again that the marriage continues to be legitimate.
