The defense for Danna Yanina ‘N’ will file an appeal to reverse her binding over for trial for the femicide of Dafne Zapata Quintos, which occurred at the Marina Doenitz Military Academy in Tamaulipas. The case has shaken Mexico due to the details revealed so far, the lines of investigation, and those involved. This is what is known about the matter.
According to reports, the Tamaulipas State Prosecutor's Office did not present evidence to support the decision to bind her over for trial, which is why the defense will file an appeal.
"It was resolved to bind her over for trial. What does this mean? That the investigation and criminal proceedings continue; it does not mean that there is a conviction, but that there are reasonable indications that lead to the assumption of the defendant's probable involvement," explained Lizeth Flores, the lawyer for Alejandra Quintos, Dafne's mother.
Following Flores' initial statements, Yanina ‘N’'s father, Ophir Cruz, confirmed that his daughter was bound over for trial and will face the precautionary measure of preventive detention for three months, but he stated he believed in her innocence and her position as a second victim in the case.

"We would have liked to walk out hand in hand with her, because she is an innocent person, she is a victim. It is a nightmare; we have suffered an arbitrary act by the State. As we told them, there is no support whatsoever to bind her over. I am practically carrying an empty file; they are prosecuting us with an empty file," Cruz noted.
"(...) They did not let my daughter defend herself; they tied her hands. Because the complaint never arrived, nothing ever arrived to supplement the file," he pointed out.
For his part, lawyer Omar Pérez reported that they will appeal and that the family will go to the State Human Rights Commission or the National Human Rights Commission (CNDH) due to alleged irregularities in the investigation of the case.
With the appeal, Yanina could go through the process while remaining at liberty while the corresponding investigations are carried out.
Likewise, Yanina's father also alleged that his daughter was not an employee of the academy as has been claimed, nor was she the assistant to the alleged culprit Estrellita ‘N’, but that she was a student and that there is evidence of this, such as tuition payment receipts.
Among other details provided by Ophir Cruz, Yanina's mental health stands out. Apparently, during the hearing, the accused suffered a nervous breakdown that was brought under control during a recess.
